The Residential Property Disclosure in NC

The state of North Carolina requires most home sellers to complete a fairly detailed questionnaire about their property, and to provide this form to prospective buyers before they present an offer. However, new home builders, executors of estates, and companies selling a home they have foreclosed on are not required to provide the Property Disclosure.

The seller of a resale home is cautioned that their answers must be as correct as possible, to the best of the seller’s knowledge and belief. However, it is not a sworn affidavit. The form is intended to give a prospective buyer the benefit of the seller’s best good-faith understanding about the condition of their property.

The Property Disclosure provides an overview of a home’s structural and mechanical components, any permit issues, any pollutants on the land, any smoke, noise etc. from nearby areas, any flood designated areas and much more. It also includes factual information about the homeowner’s association if there is one, plus the neighborhood’s services or amenities.

Home buyers should make sure that they receive this disclosure before making an offer on a home. They should review it and ask any questions that it may bring up. Then they can sign and date the document to indicate that they have been informed about the property.

When we are working as seller’s agents or buyer’s agents, we always try to make sure that the Property Disclosure is as complete and accurate as possible. However, the disclosure does not provide an assurance that all is well with any particular property. Buyers are urged to conduct their own inspections regarding the mechanical and structural condition of the home, potential pest problems, radon, heating and cooling system and any other points that may be of concern.
