Working With Real Estate Agents in NC

When you first begin to work with a real estate agent in North Carolina, it won’t be long before he or she asks you to go over a brochure called “Working with Real Estate Agents”. The agent will ask you to sign an acknowledgment that you received the brochure. Don’t worry; it’s not a trick. The agent is just following the rules of the NC Real Estate Commission, which publishes the brochure. It is an essay about the subject of agency, and the Commission wants you to be informed. In essence, the brochure says that – when an agent officially goes to work for you as a buyer’s or seller’s agent – he or she owes you these duties: (1) promote your best interests; (2) be loyal to you; (3) follow your lawful instructions; (4) provide you with all material facts that could influence your decisions; (5) use reasonable skill, care and diligence; and (6) account for all monies they handle for you. However, the agent is not required to keep your information confidential unless and until he or she officially goes to work for you. And how does that happen? You and the agent should sign a listing agreement if you are a Seller, or a buyer’s agency agreement if you are a Buyer. We will go over those subjects in later posts.
